Data Protection: a new Bill was presented in the Chamber of Deputies

On April 29, 2025, Deputy Pablo Carro (of the Union for the Homeland bloc) filed a new bill
in the National Congress that aims to update the data protection legal framework in
Argentina (hereinafter, the “Bill”).

The Bill maintains the approach of the one presented in 2023 by the Executive Branch,
promoted by the Access to Public Information Agency and expired by parliament to date.

Some of the new features introduced include:

  • The requirement of prior communication to the data subject if the “legitimate interest”
    is to be used as a legal basis for the processing.
  • The prohibition of massively transferring databases between public sector entities.
  • The incorporation of the principle of reciprocity in matters of international transfers
    and the requirement of publication of transfers that are made in the “public interest”.
  • The possibility for the data subject to exercise the right of access by requesting the
    information in the language of their choice.
  • The incorporation of the concept of “inferred data”, understood as information
    created through reasoning or deduction and not only through the observation or
    collection of its data.
  • The setting of the initial value of a mobile unit to calculate fines at AR$ 100,000 and
    its update on a semi-annual basis.
