Decree No 302/2021 (hereinafter, “Decree 302”), published in the Official Gazette on May 08, 2021, and in force as from May 09, 2021 sets forth that definitive exports of goods registered by Micro, Small and Medium-Sized Businesses (“MiPyMEs”, as per its acronym in Spanish) will not be subject to export duties up to an annual USD 500,000 FOB value cap. For definitive exports exceeding such amount, and up to an annual USD 1,000,000 FOB value cap, a 50% reduction in the export duty rate will be applicable.
Only MiPyMEs that in the immediately previous calendar year did not register exports for more than USD 3,000,000, or did not register any exports at all, may access to the reliefs stated in Decree 302.
Reliefs stated by Decree 302: (i) shall only apply to exports of goods classified in the Mercosur Common Nomenclature (“NCM” as per its acronym in Spanish) tariff codes listed in Annex I thereto; and (ii) does not apply in case of export transactions made on behalf of third parties.
