Incentive for construction and access to housing
On April 18, 2021, Decree 244/2021 was published in the Official Gazette , which regulates Law No. 27,613 through which the Incentive Regime for Argentine Federal Construction and Access to Housing was implemented, aimed at promoting the development or investment in real estate projects carried out in the national territory. These incentives consist of a series of tax benefits applicable to new private works started after the entry into force of the law, as well as those that have a development of less than fifty percent of the work.
It also includes a “Tax Amnesty” regime called “Standardization Program to Reactivate Federal Construction Argentina”, based on the voluntary declaration of holdings in national and foreign currency for the realization of investments in construction, in relation to new real estate projects. The obligation to inform the treasury of the purchase date of the holdings, or the origin of the funds is waived, being released from all judicial action (civil, commercial, criminal and administrative).
The decree establishes details regarding the way of accrediting the percentage of progress of new private works, determined the AFIP as in charge of implementing a registry for the purpose of communicating the pertinent data of real estate projects, defined the terms in relation to the transitory application of declared funds to the purchase of national public titles, as well as the form and scope of the legally established tax benefits.
