Decree N° 35/2025: Amendment in food products import and export procedures
On January 17, 2025, the National Executive Power issued Decree N° 35/2025 (“Decree 35”), published in the Official Gazette of the Argentine Republic on January 20, 2025, through which the Argentine Food Code (“Código Alimentario Argentino” or “CAA”, for its acronym in Spanish) is amended.
With regards to the import and export operations of food products, Decree 35 establishes a simplification of the procedures, detailing the steps to be followed in each case and the information to be provided for these purposes.
For the case of:
- Imports, the requirements of the CAA will be considered satisfied for food products and/or packaging entering the country with certifications issued by countries with high sanitary surveillance (namely: Australia, Canada, Switzerland, the European Union, the United States, New Zealand, Israel, Japan, and the United Kingdom). The same applies when countries use the standards of the “Codex Alimentarius” (FAO/WHO), and in cases of imports from countries with which economic integration treaties or reciprocity agreements are in place. In this regard, only the import declaration must be completed, and the Health Authority cannot require additional demands.
- Products being exported, they must comply only with the requirements and restrictions imposed by the destination country, and the Health Authority cannot establish additional demands.
Moreover, with regard to import operations for countries not included in those previously listed, Decree 35 stipulates that an import authorization request must be completed, through which registration in the corresponding records will be processed. In these cases, the verification of the request will be the responsibility of the National Health Authority.
Finally, Decree 35 provides that, with regard to export operations, when required by the destination country, exporters may request the corresponding certificates from the National Health Authority.
Decree 35 will come into effects as of January 21, 2025.
