Decree No. 378 – Exceptional and Transitory Countervalue for the Settlement of Foreign Exchange for export operations for Regional Economies

On 07/24/2023, Decree No. 378 issued by the National Executive Branch (the “Decree 378”) was published in the Official Gazette, establishing the Exceptional and Transitory Countervalue for the Settlement of Foreign Exchange for export operations for Regional Economies.

1. The Executive Branch hereby provides that the Central Bank of the Argentine Republic (hereinafter, the “BCRA”) shall establish the mechanisms so that the parties enrolled in the Export Increase Program, which liquidate foreign currency until August 31, 2023, have access to AR$ 340 for each U$D corresponding to the goods included in Chapter II of Decree No. 194/23. It also provides that such parties shall apply the referred countervalue for the payment of duties, taxes and other charges.
2. Those who have liquidated the foreign currency as of May 31, 2023 shall maintain the exceptional and transitory countervalue of AR$ 300 established in Decree No. 194/23 and the provisions regarding obligations and registrations established therein shall be applicable to them.
3. In the case of goods requering Affidavits of Sales Abroad (“DJVE” as per its acronym in Spanish, i.e.: “Declaración Jurada de Venta al Exterior”), their registration and the payment of the respective obligations must be completed up to November 30, 2023, included.
4. Export operations with DJVE prior or subsequent to the entry into force of the decree, including those with a price in pesos “to be fixed”, shall be considered included in the program.
5. The Secretariat of Agriculture, Livestock and Fisheries may grant an additional automatic extension for the DJVE with shipment date and the automatic extension until September 30, 2023, of the goods it considers, for a term of up to 240 calendar days.
