Extension of the prohibition to dismiss or suspend

 

On April 22th, 2021 Decree No. 266/2021 was published in the Official Gazette establishing the following:

  • Extends until May 31st, 2021, the prohibition to dismiss without cause or due to force majeure or lack or reduction of work not imputable to the employer.
  • Extends until May 31st, 2021, the prohibition to suspend employees on the basis of force majeure or lack or reduction of work not imputable to the employer. However, the Decree exempts from the said before prohibition the suspensions made in the terms of Section 223 bis, Labor Contract Act, which do not have time limits.
  • In the event of not complying with the aforementioned prohibitions, said dismissals and suspensions shall not be effective and the existing labor relations will remain in force under their current conditions.
  • The above-mentioned prohibitions do not apply to: (i) the labor relationships in the private sector that started after December 14th, 2019; (ii) the employees who are under the scope of legal regime of the construction activity (Law No. 22,250); and (iii) the public sector employees.
  • Provides that until May 31st, 2021, the Covid-19 will be considered “presumptively” a professional disease -not listed- in Law No. 24,557 regarding to those employees who do not work under a home office regime.
